Ordinances for the People
“Now these are the ordinances which you are to set before them:
“Now these are the ordinances which you are to set before them:
А оце зако́ни, що ти викладеш перед ними:
“If you buy a Hebrew slave, he shall serve for six years; but on the seventh he shall go out as a free man without payment.
Коли купиш єврейського раба, нехай він працює шість років, а сьомого нехай вийде да́рмо на волю.
“If he comes alone, he shall go out alone; if he is the husband of a wife, then his wife shall go out with him.
Якщо при́йде він сам один, нехай сам один і вийде; коли він має жінку, то з ним вийде й жінка його.
“If his master gives him a wife, and she bears him sons or daughters, the wife and her children shall belong to her master, and he shall go out alone.
Якщо пан його дасть йому жінку, і вона породить йому синів або дочо́к, — та жінка та діти її нехай будуть для пана її, а він нехай вийде сам один.
“But if the slave plainly says, ‘I love my master, my wife and my children; I will not go out as a free man,’
А якщо раб той щиро скаже: „Полюбив я пана свого, жінку свою та дітей своїх, — не вийду на волю“,
then his master shall bring him to God, then he shall bring him to the door or the doorpost. And his master shall pierce his ear with an awl; and he shall serve him permanently.
то нехай його пан приведе́ його до суддів, і підведе його до дверей або до бічни́х одві́рків, та й проколе пан його вухо йому шилом, — і він буде робити йому повіки!
“If a man sells his daughter as a female slave, she is not to go free as the male slaves do.
А коли хто продасть дочку́ свою на неві́льницю, — не вийде вона, як виходять раби.
“If she is displeasing in the eyes of her master who designated her for himself, then he shall let her be redeemed. He does not have authority to sell her to a foreign people because of his unfairness to her.
Якщо вона невгодна в оча́х свого пана, який призна́чив був її собі, то нехай позволить її викупити. Не вільно йому продати її до народу чужого, коли зрадить її.
“If he designates her for his son, he shall deal with her according to the custom of daughters.
А якщо призна́чить її для сина свого, то зробить їй за правом дочо́к.
“If he takes to himself another woman, he may not reduce her food, her clothing, or her conjugal rights.
Якщо візьме собі іншу, то не зменшить поживи їй, одежі їй і подру́жнього пожиття́ їй.
“If he will not do these three things for her, then she shall go out for nothing, without payment of money.
А коли він цих трьох речей не робитиме їй, то вона вийде да́рмо, без о́купу.
Personal Injuries
“He who strikes a man so that he dies shall surely be put to death.
Хто вдарить люди́ну, і вона вмре, той конче буде забитий.
“But if he did not lie in wait for him, but God let him fall into his hand, then I will appoint you a place to which he may flee.
А хто не чатува́в, а Бог підвів кого в його руку, то дам тобі місце, куди той утече.
“If, however, a man acts presumptuously toward his neighbor, so as to kill him craftily, you are to take him even from My altar, that he may die.
А коли хто буде замишляти на ближнього свого, щоб забити його з хитрістю, — ві́зьмеш його від же́ртівника Мого на смерть.
“He who strikes his father or his mother shall surely be put to death.
А хто вдарить батька свого чи матір свою, той конче буде забитий.
“He who kidnaps a man, whether he sells him or he is found in his possession, shall surely be put to death.
А хто вкраде люди́ну і продасть її, або буде вона зна́йдена в руках його, той конче буде забитий.
“He who curses his father or his mother shall surely be put to death.
І хто проклинає батька свого чи свою матір, той конче буде забитий.
“If men have a quarrel and one strikes the other with a stone or with his fist, and he does not die but remains in bed,
А коли будуть свари́тися люди, і вдарить один о́дного ка́менем або кулаком, і той не вмре, а зляже на посте́лю,
if he gets up and walks around outside on his staff, then he who struck him shall go unpunished; he shall only pay for his loss of time, and shall take care of him until he is completely healed.
якщо встане й буде проходжуватися надворі з опертям своїм, то буде оправданий той, хто вдарив, тільки нехай дасть за прогаяння ча́су його та справді вилікує.
“If a man strikes his male or female slave with a rod and he dies at his hand, he shall be punished.
А коли хто вдарить раба свого або невільницю свою києм, а той помре під рукою його, то конче буде покараний той.
“If, however, he survives a day or two, no vengeance shall be taken; for he is his property.
Тільки якщо той переживе день або два дні, то не буде покараний, бо він — його гроші.
“If men struggle with each other and strike a woman with child so that she gives birth prematurely, yet there is no injury, he shall surely be fined as the woman’s husband may demand of him, and he shall pay as the judges decide.
А коли будуть битися люди, і вдарять вагі́тну жінку, і скине вона дитину, а іншого нещастя не станеться, то конче буде покараний, я́к покладе на нього чоловік тієї жінки, і він дасть за присудом суддів.
“But if there is any further injury, then you shall appoint as a penalty life for life,
А якщо станеться нещастя, то даси ду́шу за ду́шу,
eye for eye, tooth for tooth, hand for hand, foot for foot,
око за око, зуба за зуба, руку за руку, ногу за ногу,
burn for burn, wound for wound, bruise for bruise.
опа́рення за опарення, рану за рану, синяка за синяка.
“If a man strikes the eye of his male or female slave, and destroys it, he shall let him go free on account of his eye.
А коли хто вдарить в око раба свого, або в око невільниці своєї, і знищить його, той на волю відпустить його за око його.
“And if he knocks out a tooth of his male or female slave, he shall let him go free on account of his tooth.
А якщо виб'є зуба раба свого, або зуба невільниці своєї, той на волю відпустить того за зуба його.
“If an ox gores a man or a woman to death, the ox shall surely be stoned and its flesh shall not be eaten; but the owner of the ox shall go unpunished.
А коли віл ударить чоловіка або жінку, а той умре, конче буде вкамено́ваний той віл, і м'ясо його не буде їджене, а власник того вола невинний.
“If, however, an ox was previously in the habit of goring and its owner has been warned, yet he does not confine it and it kills a man or a woman, the ox shall be stoned and its owner also shall be put to death.
А якщо віл був битли́вим і вчора, і третього дня, і було те засвідчене у власника його, а той його не пильнував, і заб'є той віл чоловіка або жінку, — буде він укамено́ваний, а також власник буде забитий.
“If a ransom is demanded of him, then he shall give for the redemption of his life whatever is demanded of him.
Якщо на нього буде накладений ви́куп, то дасть викупа за душу свою, скільки буде на нього накла́дене.
“Whether it gores a son or a daughter, it shall be done to him according to the same rule.
Або вдарить віл сина, або вдарить дочку́, — буде зро́блено йому за цим законом.
“If the ox gores a male or female slave, the owner shall give his or her master thirty shekels of silver, and the ox shall be stoned.
Коли вдарить той віл раба або невільницю, то власник дасть панові того тридцять шеклів срібла, а віл той буде вкамено́ваний.
“If a man opens a pit, or digs a pit and does not cover it over, and an ox or a donkey falls into it,
А коли хто розкриє яму, або викопає яму й не закриє її, і впаде́ туди віл або осел,
the owner of the pit shall make restitution; he shall give money to its owner, and the dead animal shall become his.
власник ями відшкодує, — верне гроші власникові його, а загинуле буде йому.
“If one man’s ox hurts another’s so that it dies, then they shall sell the live ox and divide its price equally; and also they shall divide the dead ox.
А коли чийсь віл ударить вола його ближнього, і згине той, то продадуть вола живого, а гроші за нього поділять пополови́ні, і також загинулого поділять пополови́ні.
“Or if it is known that the ox was previously in the habit of goring, yet its owner has not confined it, he shall surely pay ox for ox, and the dead animal shall become his.
А коли буде відо́ме, що віл був битли́вим і вчо́ра й третього дня, а власник його не пильнував його, то конче нехай відшкоду́є вола за того вола, а забитий буде йому.
